1. Acceptance of Terms

By accessing or using FernHost services ("Services"), including game server hosting, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Services.

2. Eligibility

You must be at least 18 years old or have legal parental or guardian consent to use our Services.

3. Services Provided

FernHost provides hosting services, including but not limited to Minecraft game server hosting. Services are provided on an "as is" and "as available" basis.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Acceptable Use Policy

You agree not to use the Services for:

• Illegal activities
• Distribution of malware or harmful content
• Unauthorized access to systems or networks
• Activities that disrupt or degrade our infrastructure or other users

We reserve the right to suspend or terminate accounts violating this policy at our sole discretion.

6. Payments and Billing

All Services are billed on a recurring monthly subscription basis unless otherwise stated.

Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to renewal.

All fees are billed in advance and are non-refundable except as expressly stated in this agreement.

We use third-party payment processors, including Stripe and PayPal. By making a purchase, you agree to their respective terms and policies.

Failure to pay on time may result in suspension or termination of Services.

7. Refund Policy

All payments are final and non-refundable unless required by law.

We may, at our sole discretion, provide refunds in exceptional circumstances. Refund requests must be submitted within 48 hours of purchase.

Billing Disputes and Chargebacks

You agree to contact FernHost LLC prior to initiating any chargeback or payment dispute.

Failure to contact us prior to initiating a dispute may result in:

• Immediate suspension or termination of Services
• Permanent account ban
• Forfeiture of any eligibility for refunds or credits

If a chargeback or dispute is initiated, you agree that FernHost LLC may provide relevant account and usage information to the payment processor to contest the dispute.

We reserve the right to recover any fees, costs, or losses associated with chargebacks, including administrative and processing fees, to the fullest extent permitted by law.

8. Service Availability (No Uptime SLA)

FernHost LLC does not guarantee any specific uptime percentage or service level agreement (SLA). All Services are provided on an "as is" and "as available" basis.

While we strive to maintain high availability, interruptions may occur due to maintenance, network issues, hardware failures, or factors beyond our control.

In certain cases, and solely at our discretion, we may provide service credits or extend a customer's service period as compensation for downtime. Such compensation is not guaranteed and shall be the exclusive remedy for any service interruption.

FernHost LLC shall not be liable for any damages, losses, or claims arising from service outages or downtime.

9. Data and Backups

Customers are solely responsible for maintaining backups of their data. FernHost does not guarantee data preservation.

10. Abuse, DMCA, and Copyright Policy

FernHost LLC respects intellectual property rights and expects users to do the same.

If you believe content hosted on our Services infringes your copyright, you may submit a notice to: [email protected]

Your notice should include:

• Identification of the copyrighted work
• Identification of the infringing material and its location
• Your contact information
• A statement of good faith belief that the use is unauthorized
• A statement under penalty of perjury that the information is accurate

We reserve the right to remove or disable access to allegedly infringing content and to terminate repeat infringers.

We also prohibit abusive activities, including but not limited to:

• DDoS attacks or attempting to disrupt services
• Hosting malicious software
• Operating illegal services or content

We may suspend or terminate Services immediately upon detection of abuse, without notice or refund.

11. Termination

We may suspend or terminate your account at any time, with or without cause, and without liability.

Upon termination, your right to use the Services will immediately cease.

12. Limitation of Liability

To the fullest extent permitted by law, FernHost LLC shall not be liable for any indirect, incidental, special, or consequential damages.

Our total liability shall not exceed the amount paid by you for the Services in the preceding 30 days.

13. Indemnification

You agree to indemnify and hold harmless FernHost LLC from any claims, damages, or expenses arising from your use of the Services.

14. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.
